Gabriel Sales Terms of Use

These terms govern your use of gabrielsales.com. They are deliberately short. If you are a Gabriel Sales client, the agreement you signed governs your engagement, not this page.

1. Who We Are

This website is operated by Gabriel Systems Inc, doing business as Gabriel Sales (“Gabriel Sales,” “we,” “us,” “our”), a company located in Boulder, Colorado 80303, United States.

By using this website you agree to these terms. If you do not agree with them, please do not use the site.

2. What These Terms Cover

These terms apply to gabrielsales.com, our Marketing Cloud Account Engagement landing pages at go.gabrielsales.com, and the content, tools, downloads and forms on them.

They do not govern our services. If you engage Gabriel Sales for an implementation, audit, optimization, migration, managed services or training, that work is governed by the written proposal, statement of work or master services agreement you sign with us. Where those documents and this page disagree, those documents win.

How we handle personal information is covered separately in our Privacy Policy at https://gabrielsales.com/privacy-policy/, which forms part of these terms.

3. Using This Site

You may read, browse, print and share our content for your own business or personal use, and you may quote from it with attribution. We would rather you linked to the original than copied it wholesale, but a reasonable excerpt with a link back is always fine.

You may not republish our content as your own, sell it, or present it as another firm’s work product. You may not remove our name, logo or copyright notices from anything you share.

4. Our Content and Trademarks

Everything on this site, the written content, video, images, downloadable guides, checklists, frameworks and page design belongs to Gabriel Sales or to the people who licensed it to us, and is protected by copyright.

“Gabriel Sales” and the Gabriel Sales Automation & Sales Enablement Maturity Matrix™ are our marks. You may refer to them in ordinary descriptive use, including in reviews, comparisons and commentary. You may not use them in a way that suggests we endorse, sponsor or are affiliated with you when we are not.

5. AI Crawlers, Indexing and Citation

We want this site read, indexed and cited. 

Search engines and AI systems are welcome to crawl our public pages, use them to answer questions, and quote from them, consistent with the permissions in our robots.txt file and our machine-readable summary at https://gabrielsales.com/llms.txt, both of which are published for exactly that purpose.

We ask two things in return. Attribute us and link to the source page where the format allows it. And do not present our content as your own, or as the output of an unrelated business.

This permission covers crawling, indexing, summarizing, quoting and citation. It is not a license to reproduce our downloadable guides, video or frameworks in full, or to build a competing product from them.

Automated access must be reasonable. Requests that degrade the site for other visitors, ignore our robots.txt, or attempt to bypass rate limiting or security controls are covered by Section 6, whether a human or a machine makes them.

6. Things You May Not Do

Use the site for any unlawful purpose, or in a way that breaches these terms.

Attempt to gain unauthorized access to the site, our servers, our systems or any account, or probe, scan or test their security.

Interfere with the site’s operation, introduce malicious code, or place a load on it that degrades service for others.

Harvest email addresses or personal information from the site for unsolicited marketing.

Impersonate Gabriel Sales, any of our people, or any other person or organization.

Use the site to develop a product or service that competes with ours by copying our content, frameworks or methodology.

We may suspend or block access to anyone who does these things, without notice.

7. Forms, Submissions and Feedback

When you complete a form, subscribe, register for a workshop or contact us, you agree the information you give us is accurate and that you are entitled to provide it. Our Privacy Policy explains what we do with it.

If you send us feedback, suggestions or ideas about our services or content, you agree we may use them freely and without obligation to you. We are not asking you to send us confidential information through this website, and you should not — use a signed agreement for that.

8. Free Resources and the Health Check

We publish a lot of free material, and we offer a free Salesforce Technology Health Check. All of it is provided for general information.

Using a free resource or taking a Health Check does not create a consulting, advisory or professional relationship between us, and does not obligate either of us to anything further. A consulting relationship begins only when we both sign an agreement.

Our content describes what we have seen work across many Salesforce and marketing automation environments. Your environment is not one of those, so treat what you read here as a starting point for your own judgment, not as a recommendation for your specific situation.

9. No Professional Advice

Nothing on this site is legal, tax, financial, accounting or regulatory advice. Where we discuss privacy law, data governance, deliverability rules or platform licensing and costs, we are describing our understanding as practitioners at the time of writing. Rules change and vendors change their pricing. Confirm anything that matters with a qualified professional and with the vendor.

Statements about Salesforce products, editions, features, pricing and roadmaps reflect our understanding at the time of publication and are not commitments by Salesforce or by us.

10. Third-Party Sites, Platforms and Trademarks

This site links to other websites and platforms, including LinkedIn, YouTube, Udemy, Salesforce and our clients’ sites. We do not control them and we are not responsible for their content, their availability or their privacy practices. A link is not an endorsement.

Gabriel Sales is an independent Salesforce consulting partner. We are not Salesforce, we do not speak for Salesforce, and we use these names only to describe the platforms we work in.

11. Availability and Accuracy

We work to keep this site accurate and available, but we do not promise either. Content may become out of date, and pages may be changed, moved or taken down without notice. The site may be unavailable for maintenance or for reasons outside our control.

The site and its content are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Gabriel Sales and its officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data, goodwill or business opportunity, arising out of your use of this site or your reliance on anything published here, even if we were advised such damages were possible.

Where liability cannot be excluded, our total aggregate liability arising from your use of this site is limited to one hundred US dollars ($100).

This section limits our liability for the website only. Liability under a signed services agreement is governed by that agreement.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence.

13. Indemnification

You agree to indemnify and hold Gabriel Sales harmless from any claim, loss, liability or expense, including reasonable legal fees, arising out of your misuse of this site, your breach of these terms, or your violation of any law or the rights of a third party.

14. Governing Law

These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law rules. Any dispute arising out of these terms or your use of this site will be brought exclusively in the state or federal courts located in Boulder County, Colorado, and you consent to the jurisdiction of those courts.

If any part of these terms is found unenforceable, the rest continues to apply.

15. Changes to These Terms

We may update these terms from time to time. We will change the “Last updated” date at the top, and continuing to use the site after a change means you accept the updated terms. If a change is significant we will say so on the site.
